If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

You represent and warrant that:

• You have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase
• The information you supply to us is true, correct, and complete

The Service may employ the use of third-party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.

We reserve the right to refuse or cancel your order at any time for reasons including but not limited to:

• Errors in your order

By purchasing from the website, you agree to all terms and conditions herein.

All products or services purchased are provided solely for your personal use (or, if given as a bona fide gift, for the personal use of one end-user recipient). You may not resell, redistribute, export, transfer, display for sale, or otherwise commercially dispose of any product without prior written consent.

Prohibited resale activities include:

• Listing products on third-party marketplaces or social media storefronts
• Bulk purchasing for resale
• Altering or removing trademarks, serial numbers, or identifiers
• Representing yourself as an authorized distributor or agent

We reserve the right to screen, limit, refuse, or cancel orders and suspend or terminate accounts reasonably suspected of engaging in prohibited resale activity.

Any warranty, satisfaction guarantee, return right, or promotional benefit terminates upon unauthorized resale, except where prohibited by law.

We reserve all remedies available at law and in equity, including injunctive relief, damages, disgorgement of profits, and recovery of attorneys’ fees. You agree to indemnify and hold harmless GOZO , its affiliates, officers, directors, employees, and agents from any claim or liability arising from breach of this section.

SMS/MMS Mobile Message Marketing Program Terms & Conditions

GOZO  (“We,” “Us,” “Our”) offers a mobile messaging program (the “Program”) subject to these Mobile Messaging Terms & Conditions and our Privacy Policy.By opting in or participating in the Program, you agree to these terms, including binding individual arbitration as described below.

The Program allows users to receive SMS/MMS mobile messages by affirmatively opting in through online or application-based enrollment forms.

By participating in the Program, you agree to receive autodialed or prerecorded marketing mobile messages at the phone number associated with your opt-in. Consent is not required to make a purchase.

Message and data rates may apply. Message frequency varies.

To opt out of the Program, reply:

• STOP
• END
• CANCEL
• UNSUBSCRIBE
• QUIT

to any mobile message from Us.You may receive a confirmation message confirming your opt-out request.

You acknowledge that alternative opt-out methods may not be recognized or honored.

Users enrolled in the Program may receive messages regarding:

• Marketing and promotions
• Product announcements
• Payment confirmations
• Delivery updatesCheckout reminders
• General sales communications

Message and data rates may apply.

You agree to receive recurring messages at varying frequencies, including daily, weekly, or monthly communications depending on your interaction with Us.

Please note that email is not a valid method for opting out of SMS communications.

If your mobile device does not support MMS messaging, the Program may send SMS terminating messages instead.

The Program is provided on an “as-is” basis and may not be available in all locations or at all times.

We are not responsible for delays or failures in message delivery caused by:

• Wireless carriers
• Network outages
• Software issues
• Coverage limitations
• Other third-party service interruptions

Carriers are not liable for delayed or undelivered messages.

To participate, you must:

• Own a wireless device capable of two-way messaging
• Use a participating wireless carrier
• Maintain active text messaging service

Not all mobile providers support the Program.

You may not use or engage with the Platform if you are under thirteen (13) years of age.Users between thirteen (13) and eighteen (18) years of age must have permission from a parent or legal guardian.

By participating, you represent that:

• You are at least thirteen (13) years old
• You have parental permission if required
• You are legally permitted to participate under applicable law

You agree not to transmit prohibited content through the Platform, including:

• Fraudulent or defamatory material
• Harassment, threats, or stalking
• Obscene or discriminatory content
• Malware, viruses, or harmful code
• Illegal products, services, or promotions
• Protected health information under HIPAA or HITECH
• Any content prohibited by applicable law

Any dispute arising from or relating to the Program will be resolved through binding arbitration in Boston, Massachusetts.

By agreeing to these terms:

• You waive the right to a jury trial
• You waive participation in class actions or representative proceedings
• Arbitration will be conducted under the American Arbitration Association (“AAA”) rules
• Each party is responsible for its own arbitration costs unless otherwise awarded by the arbitrator.

This arbitration provision survives termination of participation in the Program.

We endeavor to comply with the Florida Telemarketing Act and Florida Do Not Call Act where applicable.

For compliance purposes, we may assume you are a Florida resident if:

• Your shipping address is in Florida
• Your phone number uses a Florida area code

If you are a Florida resident, certain transactional or service-related text messages may not constitute telephonic sales calls under applicable Florida law.

You represent that you have the authority to agree to these Terms and that doing so does not violate any other agreement.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

We reserve the right to update or modify these Terms at any time. Continued participation in the Program following updates constitutes acceptance of the revised Terms.
